WildRock® Trailblazers™

Waiver, Assumption of Risk and Release of Liability

This Waiver, Assumption of Risk and Release of Liability (“Agreement”) is entered into by the undersigned individual (“Participant”) in connection with Participant's participation in programs, workshops, events and activities offered by WildRock Public Relations & Marketing, LLC, doing business as WildRock Trailblazers (“WildRock Trailblazers”) (each, an “Activity”). Activities take place at various locations throughout Colorado, including private residences, and this Agreement applies to all Activities Participant attends unless replaced by a later signed agreement. By signing below, Participant agrees to the following terms.

1. Assumption of Risk

Participant understands that participating in WildRock Trailblazers Activities carries inherent risks, whether an Activity is held at a business location, a rented venue or a private residence. These risks include, without limitation, uneven or slippery walking surfaces, stairs, steps, decks, patios, pools, outdoor terrain, landscaping, furniture and fixtures, pets or animals present, interaction with other participants and consumption of food and beverages. Participant voluntarily assumes all such risks, known and unknown, understanding they may result in bodily injury, illness, death or property damage, and agrees this assumption of risk applies regardless of who owns or controls the Activity location.

2. Alcohol and Liquor Consumption

Alcohol at WildRock Trailblazers Activities is typically bring-your-own and self-served by attendees; WildRock Trailblazers does not sell, supply or serve alcohol. Only persons twenty-one years of age or older may bring, serve or consume alcohol, and Participant may be asked to show valid identification. WildRock Trailblazers may ask any visibly intoxicated guest to stop drinking or to leave the Activity. Participant is solely responsible for any alcohol Participant brings or consumes, agrees to drink responsibly and to arrange safe transportation, such as a designated driver or rideshare, before consuming alcohol, and voluntarily assumes all risk of injury, impairment, loss or damage arising from Participant's own alcohol consumption at the Activity.

3. Release, Waiver and Indemnification

To the fullest extent permitted by Colorado law, Participant releases, waives and forever discharges WildRock Trailblazers, its owners, officers, employees, contractors and event hosts, and any private homeowner or venue hosting an Activity (together, “Released Parties”), from any and all claims for bodily injury, illness, death or property damage arising out of the ordinary negligence of a Released Party in connection with an Activity, and covenants not to sue a Released Party on such a claim. Participant further agrees to indemnify and hold the Released Parties harmless from any third-party claim arising from Participant's own acts or omissions at an Activity, including claims arising from Participant's consumption of alcohol. This release does not waive, and Colorado law does not permit Participant to waive in advance, any claim arising from a Released Party's gross negligence, willful and wanton conduct or reckless disregard for Participant's safety.

4. Code of Conduct

Participant agrees to engage in a respectful and professional manner at all Activities, to contribute positively to the learning environment and to respect the confidentiality of other participants.

5. Ownership of Creations and Intellectual Property

Participant recognizes that the models, tools and materials used in WildRock Trailblazers Activities are proprietary and the exclusive intellectual property of WildRock Trailblazers. They must not be duplicated, copied, repurposed, produced, shared or sold, or otherwise used outside the context of Participant's engagement with WildRock Trailblazers. Violations of these rights will be pursued to the fullest extent of the law.

6. Disclaimer and No Guarantees

WildRock Trailblazers is designed to provide guidance, support and tools to help Participant achieve personal and professional goals. WildRock Trailblazers is not a licensed psychologist, therapist or medical professional, and the guidance offered is strictly for coaching and personal development purposes.

7. Medical Care and Photography/Media

If Participant is injured or becomes ill at an Activity and is unable to consent, Participant authorizes WildRock Trailblazers representatives to seek emergency medical treatment on Participant's behalf, at Participant's expense. Participant understands WildRock Trailblazers may photograph or record Activities for promotional use and grants permission to use Participant's image for that purpose unless Participant notifies WildRock Trailblazers in writing in advance.

8. General Provisions

This Agreement is governed by the laws of the State of Colorado, and Participant consents to the exclusive jurisdiction and venue of the state and federal courts located in Colorado for any dispute arising from this Agreement or Participant's participation in an Activity. If a court finds any provision unenforceable, the remaining provisions remain in full effect. This Agreement is the entire agreement between Participant and WildRock Trailblazers regarding Participant's participation in Activities.

PARTICIPANT HAS READ THIS AGREEMENT IN FULL, UNDERSTANDS IT CONTAINS A RELEASE OF LIABILITY AND AN ASSUMPTION OF RISK, HAD THE OPPORTUNITY TO ASK QUESTIONS AND SIGNS IT VOLUNTARILY.
